General Terms and Conditions for using Speech Community

Preamble

By [logging on to / registering with] the SPEECH Community, users accept the following General Terms and Conditions (hereinafter the “GTC”) for using the SPEECH Community.

This site is administered by the SPEECH Community project partners (in the following "SCP"), consisting of Mind Business Consultants, Hauptsstr. 105, D-40668 Meerbusch, Germany and Strateco GmbH & Co. KG, Kaiser-Friedrich-Promenade 45, D-61348 Bad Homburg, Germany.

These GTC apply to all contents and applications of the website www.speech-community.com, including all subdomains and aliases (in the following "website").

The rules and regulations in these GTC, especially the rules regarding data storage and protection, also apply to use or partial use by other websites, which permit complete or partial access to the website.

The GTC valid at time of registration applies.

The website offers services to persons using it for their commercial, free-lance, or business activities.

The SCP are not responsible for the contents of user profiles.


1. Subject Matter

1.1. The SCP offer registered users (in the following "Users") free of charge a complete communications-platform for the exchange of information and knowledge regarding voice dialog systems. You can find details of the offers in our SERVICE area.

1.2 Usage exceeding the planned facilities of the website is only permissible with previous approval by the SCP.

1.3 Usage of the website contrary to these GTC and/or legal regulations is not allowed. The SCP explicitly reserve the right to terminate such use without notice.

1.4 The SCP may change, expand, reduce, or curtail the contents, structure, and extent of the the website as they wish, and notify users herewith that as 100% availability is not technically possible, restrictions may occur. The SCP reserve the right to briefly interrupt or reduce the services provided for reasons of maintenance, security, or capacity.

1.5 The SCP retain the right to exclude or restrict users' access for reason at any time. Grounds for such restriction or exclusion exist when a User contravenes current laws or these GTC, propagates false information, violates the rights of third parties, or misuses the services of the SCP. A user's own legitimate interests will be respected in case of exclusion or restriction.

1.6 The SCP assume no responsibility for communications between the users, or contracts which they may enter into, and is under no circumstances a partner to such contracts. All obligations arising under such contracts apply only to the users concerned. The SCP merely supply a platform to bring users together, and provide the technical facilities allowing them to contact one another. Consequently, the SCP are not responsible for contacts not made, interrupted, or otherwise disturbed. The same applies to contracts between users.

1.7 The User must register on the website. Registration opens a usage contract between the User and the SCP on the basis of these GTC, unless the SCP immediately and unequivocably reject the registration. The User warrants and represents that all of the data supplied by the User for registration is accurate and complete. The User shall report any changes in his registration data without undue delay. There is no right to register. The SCP reserve the right to cancel a User's access without notice for sufficient grounds, such as submission of false registration data or misuse of the platform.

1.8 Upon registration, the User receives a password, which he may change. The User is obliged to keep his password secret. The SCP will not reveal the password to third parties and will never ask the user for his password, except as required for cancellation of his membership (see below under Cancellation).

1.9. It is technically impossible for the SCP to determine with certainty whether any registered user is actually the person he or she represents to be. Every user is responsible for checking the identity of other users to his own satisfaction.


2. Obligations of the User

2.1 The User is obliged

2.1.1 to provide only true and non-misleading statements in the User profile and in communications with other users.

2.1.2 to exercise due business diligence in his relations with other users.

2.1.3 not to publish any illegal or libelous content.

2.1.4 to use information from queries, competitive bids, offers, or data otherwise acquired exclusively for his own business or own purposes: no further processing, provision of access, or release of data is allowed.

2.1.5 not unreasonably to annoy (particularly with spam) any other user (cf. §7 of the German Unfair Competition Act). Each User is responsible that his communications with other users comply with current law.

2.1.6 not to send chain letters, or pose the same question to multiple users.
